A 5-2 ruling by the Brazilian TSE to annul a rival's votes lifts Douglas Ruas past the 50% threshold, canceling the Rio de Janeiro runoff.

In a decision with major implications for Brazil's national political landscape, the Superior Electoral Court (TSE) voted 5-2 on October 8, 2026, to annul the 274,411 votes received by candidate Anthony Garotinho in Rio de Janeiro's gubernatorial race. The ruling mathematically elevates frontrunner Douglas Ruas of the right-wing Liberal Party (PL) from 49.27% to approximately 50.9% of valid votes. By pushing Ruas past the absolute majority threshold, the decision elects him governor in the first round and cancels the scheduled October 25 runoff.

The brazilian tse ruling is a severe blow to leftist President Luiz Inácio Lula da Silva. The canceled runoff would have pitted Ruas, an ally of former right-wing President Jair Bolsonaro, against Rio de Janeiro Mayor Eduardo Paes of the Social Democratic Party (PSD). Paes, a key local moderate, was Lula's primary regional ally and was expected to provide the president with a critical campaign platform in Brazil's third-largest electoral college ahead of the 2026 presidential election.

The legal battle centered on Garotinho, a polarizing former governor whose candidacy had been barred by regional authorities under Brazil's "Ficha Limpa" (Clean Record) law due to a prior administrative misconduct conviction. Because his final appeal was still pending on election day, Garotinho's name appeared on the ballot, and his votes were initially counted, which temporarily forced a second-round runoff between Ruas and Paes. Following the first-round vote, Garotinho attempted to withdraw his appeal, but the brazil tse rejected the withdrawal, ruled him definitively ineligible, and threw out his votes.

With the votes of the third-place finisher discarded, the state's electoral registry must now recalculate the percentages of the remaining valid votes. The court's majority, led by reporting justice Floriano de Azevedo Marques, ruled that votes cast for an ineligible candidate whose registration was denied cannot be considered valid for any purpose. The decision cements the rise of the 37-year-old Ruas, a former police officer and current president of the Rio de Janeiro State Assembly, who will become the state's youngest governor in decades.
