Labor Court Ruling Forces Gig Platforms to Share Data for Social Security Review, Upping Operating Risk

A national preliminary injunction issued by a labor court in Salvador, Bahia, has significantly raised the regulatory and operating risk for technology platforms in Brazil by mandating that they, along with the National Social Security Institute (INSS), must process accident-related social security claims from delivery drivers. The decision, handed down by the 2nd Labor Court of Salvador, specifically requires the food delivery giant iFood and its insurer MetLife to coordinate with the INSS to guarantee that claims for injured couriers are analyzed on a case-by-case basis, directly challenging the industry's independent contractor model and its low-cost labor structure.
